Lindsay Lohan gets 120 days' jail on probation violation, faces misdemeanor instead of felony theft charge

Lindsay Lohan won some and lost some Friday in court as the judge reduced a felony grand theft charge against her to a misdemeanor, then decided that the actress had nonetheless violated her probation, drawing a sentence of 120 days in jail plus 480 hours of community service.
Lohan will appeal the sentence handed down by Los Angeles County Superior Court Judge Stephanie Sautner, L.A. Now reports. The actress had been on probation related to a pair of DUI arrests in 2007.
On the good-news side for Lohan: She was expected to be released on $75,000 bail on the probation violation, L.A. Now said, and risks significantly less time behind bars if convicted of a misdemeanor rather than a felony regarding a necklace that went missing Jan. 22 from a Venice boutique. Lohan has maintained her innocence and previously refused a plea bargain that would have involved jail time.
According to L.A. Now, reporting from the Airport Courthouse on Friday, Kamofie and Co. store owner Sofia Kaman testified she didn't see the actress walk out of the store wearing the necklace but would have stopped her if she'd noticed. She said Lohan wore the necklace in the store for half an hour, checking it out in the mirror. Kaman also characterized the actress' male companion as a decoy who distracted her with conversation while Lohan put her own necklace back on over the item in question before walking out, according to TMZ.
Attorney Shawn Chapman Holley had asked the court to reduce the value of the necklace (priced $2,500 at retail) to $950, which would the matter out of the realm of grand theft. Kaman confirmed the shop had purchased the item for $850 from the designer.

LOS ANGELES - Lindsay Lohan was jailed for sometime again on Friday after a day full of happenings in which a judge reduced her jewellery theft charge, but sentenced the Lohan to four months imprisonment for violating her probation.

Looking confused and distressed, Lohan — who was locked up for two weeks last summer — was taken immediately to jail from court after a day-long preliminary hearing on charges that she stole a $2,500 gold necklace from a store in January.

The “Mean Girls” actress was ordered to stand trial on June 3 but the jewelry charge was reduced to a misdemeanour from a more serious felony, and will cut to one year her maximum time behind bars if eventually convicted.

Los Angeles judge Stephanie Sautner, however, felt the evidence Friday suggested Lohan intended to steal the jewelry.

She therefore ruled Lohan had violated her probation for a 2007 drunk driving and cocaine possession incident, and sentenced her to 120 days jail and 480 hours community service in a morgue and womens’ prison.

Lohan’s lawyer filed an immediate appeal and Lohan’s camp scrambled to post $75,000 bail and secure her release from custody pending an appeal hearing.

She was released late Friday after about five hours, according to the Los Angles County Sheriff’s Department website.

Lohan, 24, has strenuously denied that she deliberately walked out of a Los Angeles store wearing a necklace without paying. Her lawyer Friday argued that she was distracted and absent-minded when she left with the item around her neck.

Lohan’s assistant returned it to police after news leaked that a search warrant was to be served on Lohan’s house.

“There is a lot of hoopla surrounding Ms. Lohan, but at the end of the day, relatively speaking, this is not particularly serious as grand thefts go,” Lohan’s lawyer Shawn Holley said. ”This is a necklace ... that was returned 10 days later.”

But judge Sautner did not buy the defense argument. “I see the intent here and I see the level of brazenness with ’let me see what I can get away with’,” Sautner said.

“She thumbs her nose at the court, she walks into court with FU on her fingernails,” Sautner said, referring to an appearance last year by Lohan in another case.

Lohan has been in and out of rehab, jail and courtrooms multiple times since 2007. Once considered among the most promising young actresses in Hollywood, Lohan’s movie career has come to a virtual halt.

Earlier this week she secured a role in an upcoming film about New York mobster John Gotti. But it was not clear how she would fit filming around possible prolonged spells locked up.

Troubled actress Lindsay Lohan has been begging her mom to come see her ever since she got out of rehab last month and reportedly her mother is expected to visit her soon.
Dina's flying out to LA Monday to give her daughter some much needed support -- a little over a week after Linds was charged with felony grand theft, TMZ.com quoted a source sources close to Lindsay as saying.

Lindsay can't leave California because of her probation restrictions and we're told, not seeing her family has been the most difficult part.

The sources told the website that Dina and Lindsay plan to keep things simple during the visit -- hanging out at Lindsay's new place in Venice, working out together, and catching up.
